1. What Memoritie is

Memoritie is a family digital legacy service available at memoritie.com. It lets you store and organise your children’s photos, videos and moments, write time capsules and a Sealed Envelope that opens when your child turns 18, invite relatives to view and comment, receive voice blessings, and create narratives and films from your memories with the help of artificial intelligence.

By creating an account you accept these terms and the Privacy Notice. If you disagree with anything, we ask you not to use the service.

2. Your account

• You must be of legal age to create a Memoritie account.
• Profiles of minors can only be created by their parent or guardian. By creating a child’s profile you declare that you hold that status and that you authorise the processing of their data on their behalf.
• You can register with email and password, or with Google or Facebook. You are responsible for keeping your credentials safe; we recommend enabling two-step verification.
• The information you provide must be true and up to date.

3. Account holders and invited relatives

There are two ways to live Memoritie. The account holder (parent or guardian) administers the profiles, uploads the memories and decides who can see them. Invited relatives can view the album, comment, react and leave voice blessings, but they do not administer the profiles.

When you invite a relative you provide their email address. Do so only with people who expect your invitation.

4. Free trial, plans and payments

• When you register you start a free trial, with no card. Its current length is stated when you create your account and on the pricing page.
• After that you can choose one of the paid plans: Individual, Family or Legacy, billed monthly or yearly. Current prices are shown on the pricing page and during checkout, in the currency indicated there.
• Subscriptions renew automatically at the end of each period (monthly or yearly) and the corresponding charge is made, until you cancel.
• All charges are processed by Stripe. Memoritie does not store card numbers.
• You can cancel your subscription at any time from Settings or from Stripe’s billing portal. Cancellation takes effect at the end of the period already paid for: you keep access to your plan until that date and no further charges are made. If you change your mind before the period ends, you can reactivate it.

Refunds

Our policy is simple: if it is your first purchase and you write to us within 7 calendar days of the charge, we refund the full amount, no questions asked. After that period, or on renewals, we do not offer partial refunds for unused periods — cancelling prevents future charges and you keep access until the end of the paid period. None of this limits the rights the law grants you as a consumer.

Tax receipt (CFDI)

If you need an invoice, write to us at soporte@memoritie.com with your tax details and we will issue the corresponding CFDI. We are working on letting you generate it automatically from the application.

5. Your content stays yours

The photos, videos, texts, voices and other memories you upload are yours. Memoritie does not acquire ownership of them.

So that we can provide the service, you grant us a limited, non-exclusive and revocable licence over your content, for the sole purpose of operating Memoritie: storing it, processing it with the artificial intelligence tools described in the Privacy Notice and showing it to the relatives you authorise. This licence ends when you delete the content or your account, except as provided for sealed capsules.

At any time you can download a copy of all your data from Settings.

6. The Sealed Envelope and capsules

The Sealed Envelope and time capsules work by one simple, serious rule: sealing is final. Once sealed, the content cannot be edited and the application does not allow it to be opened before its opening date. The content is stored encrypted; as our Privacy Notice explains, the keys for that encryption are managed by our servers — it is not end-to-end encryption.

• Before sealing, review it calmly: the application offers no way to open it early.
• You will receive email reminders as a capsule’s opening date approaches.
• If you delete the profile a sealed capsule belongs to, its content is deleted with it.

7. Shared links

You can create public links to share a capsule or a timeline with people outside Memoritie. These links can be password-protected, can have an expiry date, and you can revoke them whenever you want.

Anyone holding the link (and the password, if you set one) will be able to see that content, so share it with the same care you would share your family’s physical album.

8. Prohibited conduct

By using Memoritie you agree not to:

• Upload illegal content, or content that harms, exploits or endangers a minor.
• Upload photos, videos or data of third parties without their permission, or of minors over whom you do not have parental authority or guardianship.
• Impersonate another person.
• Attempt to breach the security of the service or access other people’s accounts or content.
• Use the service for commercial purposes unrelated to its family purpose.

We may remove content that breaks these rules and, in serious cases, suspend or close the account.

9. Spark moderation

Sparks shared with the community go through automatic moderation on upload. In addition, anyone can report a spark; reports are reviewed and content that breaks these rules is removed.

10. Service availability

We work to keep Memoritie continuously available and to look after your memories seriously. Even so, like any online service, we cannot guarantee absolute availability: there may be maintenance, updates or failures beyond our control.

We recommend using the data export in Settings to keep your own copy of your memories.

11. Limitation of liability

To the maximum extent permitted by applicable law, Memoritie’s total liability to you for any claim arising from the use of the service is limited to the amount you paid for your subscription in the twelve months before the event giving rise to it. Nothing in these terms limits liabilities that the law does not allow to be limited.

12. Termination

You can delete your account at any time from Settings; when you do, your information is deleted in accordance with the Privacy Notice.

We may suspend or close an account that breaks these terms, in particular the conduct rules in section 8. Where reasonable, we will warn you beforehand so that you can export your data.

13. If Memoritie were to shut down

Keeping memories is a long-term commitment, and we take it seriously even in the worst case. If Memoritie had to cease operations permanently, we commit to:

• Notify you by email at least 90 calendar days before the shutdown date.
• Keep the data export tool in Settings available throughout that period, so that you can download a complete copy of your memories.
• Deliver in advance, to their creators, the contents of sealed capsules and Sealed Envelopes pending opening, so that no memory is left trapped.

14. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. For any dispute, you and Memoritie submit to the competent courts in Mexico, without prejudice to the non-waivable rights you have as a consumer under the Federal Consumer Protection Law (LFPC), including the possibility of turning to Profeco.
